04 The fine print

Terms of service.

These terms govern your use of austa. They form a legal contract between you (the user) and Bhushan Gaikwad, sole proprietor trading as “austa” (“austa”, “we”, “us”) under the laws of India. By signing in with your Instagram account or starting a subscription, you accept these terms. If you do not accept them, do not use the service.

The service

austa is an Instagram automation service. We connect to your Instagram Business or Creator account through Meta's official Login for Business flow, listen to the events Meta pushes to our webhook, and send replies on your behalf according to the automation rules you configure in the dashboard. The service is delivered as a hosted web application at app.austa.in.

Eligibility

To use austa you must be at least 16 years old, have legal capacity to enter into a binding contract in your country, and own (or be authorised to operate) the Instagram Business or Creator account you connect. We do not knowingly sign up minors; see the privacy policy on this.

Account and access

You sign in through Meta Login for Business. Meta authenticates you and returns us an OAuth access token scoped to the permissions you grant. We never receive or store your Instagram password. You are responsible for keeping your Meta account secure and for the actions taken under any session active on your austa account.

Subscription and billing

We reserve the right to change pricing for new subscribers. If we raise the price for existing subscribers, we notify you by email at least 30 days in advance; you may cancel before the change takes effect.

We do our best to detect and refuse to execute rules that would cross these lines. If you set one up anyway, we may suspend or terminate your account.

What we provide

Your content and intellectual property

You retain ownership of everything you create or upload to austa: rule names, message templates, post selections. You grant us a limited, worldwide, royalty-free licence to host and process that content solely to provide the service. We do not claim rights in your Instagram content, posts, or messages.

The austa name, logo, code, and service design are our property. Nothing in these terms transfers any of those rights to you.

Disconnection by you

You can disconnect Instagram any time from the dashboard, or by removing austa from your Instagram Apps and Websites settings. On disconnect we revoke the access token on our side and stop processing your account within seconds. Disconnecting does not cancel your subscription; do that separately if you also want billing to stop.

We may suspend or terminate your account, on reasonable notice where possible, if:

Privacy

How we collect, use, and share data is described in our privacy policy. By using austa you also accept that policy. For deletion routes, see data deletion.

Disclaimer of warranties

To the maximum extent permitted by law, austa is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

Limitation of liability

To the maximum extent permitted by law, austa is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages of any kind; for loss of profits, revenue, goodwill, audience, or data; or for actions Instagram or Meta take against your account.

Our aggregate liability for any claim arising out of or relating to the service is capped at the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in this section limits liability that cannot be excluded by law (including gross negligence, wilful misconduct, or death or personal injury caused by our negligence).

Indemnification

You agree to indemnify and hold austa harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the service, or your violation of any third-party right or applicable law in connection with the automations you run.

Force majeure

We are not liable for failure or delay caused by events outside our reasonable control, including but not limited to acts of god, network or infrastructure outages, Meta or Razorpay outages, government actions, or labour disputes.

Changes to these terms

We may update these terms from time to time. If a change is material, we notify subscribers by email and bump the version number at the top of this page at least 14 days before it takes effect. Continued use after the effective date means you accept the revised terms. The current version is always at austa.in/terms.

Governing law and disputes

These terms are governed by, and construed in accordance with, the laws of India, without regard to its conflict-of-laws rules. The competent courts in India have exclusive jurisdiction over any dispute arising out of or in connection with these terms or your use of austa.

Before going to court, we ask you to write to support@austa.in first. Most disputes are settled in an email exchange.
